My dear Mr. Melchers
I have received your letter of 30th ulto and as requested I now give you the reason why we decided to refuse German Policies as Security.
Up to the date of Wm. Pustaus failure we had been in the practise of taking Policies from him and others to cover shipments outwards & homewards. Some few days after his failure he wrote us stating the offices had given him notice that unless the premium was paid within 48 hours, the policies would not remain in force and recommending us for our own Security to pay the premium.
On receipt of Mr Pustaus letter we wrote to the following companies expressing our astonishment & to say that we held the Policies for value & in the event of loss we would look to them for payment. The only office who has so far acknowledged liability is the last one on the list, viz. “Dusseldoerfer”.1
Nord Deutsche Verrishermip Gesellschaft
Some of the offices replied to our letter declining all liability until premiums are paid and some of the others have not replied at all. Some of the Policies are to bearer and state “premium of Wm. Pustau“ and others state “premiums paid by Wm. Pustau”. Judging from the above facts I think you will agree with me that we had good reason for refusing German Policies.
If the Companies want us to take their Policies they should get Section 160 altered so far as regards Policies in third hands for value.2 I shall continue to refuse German Policies until I communicate with & receive a reply from our Head Office.
I was very glad to hear of the safe arrival of Mr Adolf André in Hamburg.
Yours very truly.
